How Onyx Collection handles personal information collected through our website, Meta and Instagram, email and telephone.

1. Who we are

Onyx Collection is a UK-based luxury yacht charter house. We provide yacht charter brokerage, bespoke yacht charter and related luxury travel and concierge services, arranged around how our clients wish to travel.

Onyx Collection is operated by Onyx Formula Ltd, company number 11832014. For the purposes of UK data protection law, Onyx Formula Ltd is the controller of personal information described in this policy.

2. Information we collect

We collect personal information that you choose to give us, and limited technical information generated when you use our website. This may include:

  • name;
  • email address;
  • telephone number;
  • charter requirements and preferences, including destinations, dates, number of guests, yacht type, budget indications and other details you volunteer;
  • enquiry and correspondence history, including notes of telephone, email, WhatsApp and in-person conversations;
  • information submitted through our website enquiry forms;
  • information submitted through Meta/Facebook lead forms and Instagram, including messages, comments and any fields Meta shares with us when you complete a lead form;
  • website usage information, such as pages viewed, referral source, approximate location, device and browser type, collected through cookies, similar technologies, Google Analytics, Google Ads and the Meta Pixel.

We do not ask children to use this website to make enquiries. If you believe we have collected information about a child, please contact us and we will delete it where appropriate.

3. How we use personal information

We use personal information to:

  • respond to enquiries and understand what you are looking for;
  • provide yacht charter recommendations, availability and quotations;
  • communicate with you about your enquiry, itinerary and any booking;
  • arrange and manage charter services, including liaison with yacht owners, managers, crew and other suppliers;
  • personalise our service and remember preferences you have shared with us;
  • improve our website, enquiry process and services;
  • meet legal, accounting and regulatory obligations; and
  • prevent fraud and protect our business and clients.

Sending us an enquiry, completing a website form or submitting a Meta or Instagram lead form does not automatically subscribe you to marketing. We use that information to deal with your request. Marketing is described separately below.

Under UK GDPR, we only use personal information where we have a lawful basis. Depending on the circumstances, this may be:

  • taking steps at your request before entering into a contract — for example, responding to an enquiry and preparing recommendations or a quotation;
  • performance of a contract, where we have agreed to arrange or manage a charter or related services for you;
  • our legitimate interests, such as operating and improving the website, keeping records of enquiries, understanding demand, protecting our business against misuse, and following up professionally on a request you have made, provided those interests are not overridden by your rights;
  • compliance with a legal obligation, including tax, accounting and regulatory record-keeping; and
  • consent, where the law specifically requires it — for example certain cookies or marketing messages. Where we rely on consent, you may withdraw it at any time.

5. Sharing information

Arranging a charter is rarely something we can do in isolation. Where it is necessary to respond to you or to provide the services you have asked for, we may share relevant information with:

  • yacht owners and yacht management companies;
  • central agents and other charter brokers;
  • captains, crew and onboard teams;
  • suppliers involved in the trip, such as transfer, provisioning or concierge partners;
  • payment providers, where a payment is being arranged;
  • technology providers who host or support our website, email, analytics, advertising tools and customer records; and
  • professional advisers, such as accountants or lawyers, where required.

We share only what is needed for the purpose in question. Onyx Collection does not sell personal information.

6. International transfers

Yacht charter is an international business. Some yacht owners, managers, brokers, crew and suppliers, and some of the technology providers we use (including analytics and advertising platforms), may be based outside the United Kingdom.

Where personal information is transferred outside the UK, we take steps to ensure that appropriate safeguards are in place where UK law requires them, such as relying on an adequacy decision or using standard contractual clauses. 7. Data retention

We keep personal information only for as long as is reasonably necessary for the purposes for which it was collected, including to deal with your enquiry, to manage a booking, and to meet legal, accounting and record-keeping requirements.

How long that is depends on the nature of the relationship. When information is no longer required, we delete or anonymise it where it is practical to do so.

8. Data security

We use reasonable technical and organisational measures to protect personal information against unauthorised access, loss, misuse or alteration. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

9. Marketing

From time to time we may send information about yachts, destinations or services that we think will be of genuine interest. We will only do so where UK law allows, and where consent is required we will ask for it. We may also advertise our services through Google Ads, Meta and Instagram, including measuring whether those ads lead to enquiries.

Completing an enquiry or lead form is not, on its own, treated as a request for marketing. If you receive marketing from us and would prefer not to, you can opt out at any time by using the unsubscribe link in an email or by writing to info@onyxcollection.co. We will still contact you as needed about an active enquiry or booking.

10. Cookies and analytics

This website may use cookies and similar technologies for essential functionality, to understand how the site is used, to improve it, and to measure and deliver advertising. We currently use Google Analytics, Google Ads and the Meta Pixel. These tools may set cookies or use similar identifiers and may collect information such as pages visited, device type and approximate location.

Essential cookies are needed for the site to work. Analytics and advertising technologies help us see which pages are useful and measure the effectiveness of our advertising, including Google Ads and advertising on Meta and Instagram. Google Ads may also be used to measure conversions and to show relevant ads to people who have visited this website. You can control or delete cookies through your browser settings, and you can manage Google ad personalisation through Google Ads Settings. Blocking some cookies may affect how the site behaves.

There is no separate cookie policy. This section is the current explanation of how we use cookies and similar technologies.

11. Your rights

Under UK GDPR, you have the following rights in relation to your personal information, subject to certain legal limits:

  • the right to access a copy of the information we hold;
  • the right to have inaccurate information corrected;
  • the right to request erasure in certain circumstances;
  • the right to restrict processing in certain circumstances;
  • the right to object to processing based on legitimate interests, and to object to direct marketing;
  • the right to data portability, where processing is carried out by automated means and based on consent or a contract; and
  • the right to withdraw consent, where we are relying on consent. Withdrawal does not affect processing already carried out.

If you are concerned about how we have used your information, please contact us first so that we can try to put it right.
